1. About this policy
1.1 This policy sets out what you may not do with Verbier. It applies to everyone who uses the Service, including the homepage demo, and forms part of our Terms of Service. Words with capital letters have the meanings given in the Terms of Service.
1.2 "You" includes anyone who uses the Service through your Account or API Keys. You are responsible for making sure they follow this policy.
2. Unlawful and harmful content
2.1 You must not submit, link to, or produce Output from any content that:
(a) is unlawful, or that you do not have the right to use;
(b) depicts, promotes or facilitates the sexual abuse or exploitation of children, or sexualises anyone under 18 in any way;
(c) is an intimate image of a person shared or created without their consent, or is used to create, alter or share such an image;
(d) encourages or promotes terrorism or violent extremism, or incites violence or hatred against any person or group; or
(e) is used to harass, bully, threaten, stalk or intimidate anyone, or to publish their private information without their consent.
2.2 If we become aware of content that appears to involve child sexual abuse, we will report it to the National Crime Agency and, where appropriate, the Internet Watch Foundation, and will preserve and disclose information as the law requires.
3. Deception and impersonation
3.1 You must not use the Service to:
(a) create images intended to make people believe something false about a real person, including deceptive "deepfake" material, or to impersonate any person or organisation;
(b) produce or alter identity documents, official records, evidence or other material intended to deceive or defraud anyone; or
(c) edit images of an identifiable real person in a way that requires their consent without obtaining it.
4. Intellectual property
4.1 You must not use the Service to infringe anyone's copyright, trade marks, design rights or other intellectual property rights.
4.2 In particular, you must not use the Service to remove, alter or obscure watermarks, copyright notices or other rights management information from images you do not have the rights to, including where doing so would breach section 296ZG of the Copyright, Designs and Patents Act 1988.
5. Privacy
5.1 You may only submit images of identifiable people where you have a lawful basis under data protection law to do so and, where the law requires it, their consent.
5.2 You must not use the Service for unlawful surveillance, or to profile, track or identify individuals.
6. Security and fair use
6.1 You must not:
(a) access or try to access the Service other than through the API and Website using a valid API Key or Account, or access another person's Account or API Keys;
(b) probe, scan or test the vulnerability of the Service, or run load or stress tests against it, without our written permission. If you find a security issue, please report it to hello@verbier.dev;
(c) interfere with or disrupt the Service or the infrastructure it runs on, including by sending malicious code, requests designed to exhaust its resources, or excessive automated traffic;
(d) get around any limit, Allowance, watermark, content check or security measure in the Service;
(e) open more than one Account to obtain more free images, or share, sell, publish or otherwise give API Keys to anyone outside your organisation; or
(f) give the Service an image URL that you are not entitled to access, or use the Service to reach private or internal networks.
7. Reverse engineering and competing services
7.1 You must not:
(a) decompile, disassemble or reverse engineer the Service, or try to extract our models, weights or source code, except to the extent the law allows despite this restriction;
(b) resell, sublicense or provide access to the API itself as a standalone background removal service, or offer a service whose main purpose is to pass requests through to the API. Building your own products and services that use the Output is allowed; or
(c) systematically collect Output at scale in order to train or develop a competing background removal model or dataset.
7.2 You may evaluate and benchmark the Service, including comparing it with other services and publishing the results.
8. Reporting misuse
8.1 If you see the Service being misused, please tell us at hello@verbier.dev.
9. If you break this policy
9.1 If we reasonably believe you have broken this policy, we may take any action we consider proportionate, including:
(a) refusing to process requests;
(b) revoking API Keys;
(c) suspending or closing your Account under clause 14 of the Terms of Service;
(d) reporting the matter to law enforcement or other authorities and disclosing information to them as the law allows or requires; and
(e) if you are a Business Customer, recovering our losses from you under clause 16.5 of the Terms of Service.
10. Changes to this policy
10.1 We may update this policy from time to time. Material changes will be made in line with clause 18 of the Terms of Service. The date at the top shows when this policy last changed.
